Most driving under the influence (DUI) charges begin as a traffic stop by a police officer. The remainder typically involves accidents in which an officer arrives to the accident scene. Secondly, the officer will ?ask? you to perform field sobriety tests (FST) including a preliminary breath test (PBT). If there is an arrest made, you will finally be required to submit to a breath or blood test.

When you are stopped for a traffic matter, you are required to provide your driver?s license and registration. You are not required to answer any other questions unless it pertains to those documents. If you are suspected of driving under the influence, you will be asked to step out of the car. From this point forward, everything the officer asks you to do is for his benefit and not yours. The FSTs that he will ask you to perform help him to establish probable cause to arrest you for DUI. You are not required to perform any of these tests.

You may politely refuse to subject yourself to FST and PBT, but you should be aware that you will more than likely be placed under arrest for DUI at that point. While that may seem unfair, it is more than likely that if you are asked to perform the FST, the officer has already made the decision that you are intoxicated. It is extremely rare that anyone who has been asked to complete the FST ends up not being arrested. Odds are you will only hurt your chances if you take the tests. Why should you give the officer more information to use against you at your DUI trial?

If you are arrested for DUI, you are required under the Virginia Implied Consent Law to submit to a breath test. You do not have the option to ask for a blood test if a breath test is available. The officer may opt to have you take a blood test in some circumstances, and you are then required to submit to that as well. A refusal to give a blood or breath test is a separate charge and is punishable by a loss of your license for at least one year with no possibility of a restricted license.

If you are veterans who have served during peacetime periods or active duty military personnel, you must have had more than 180 days active service. If you are enlisted veterans after September 7, 1980, or officers with service after October 16, 1981, you must have had at least 2 years service in most cases.

If you are the Selected Reserve members, including the National Guard, who have completed 6 years of service and been honorably released, or have completed 6 years of service and are still serving, then you will be eligible for VA direct home loans. (However, as a reservist, you should be prepared for the possibly higher funding fee than regular veterans.)

Plus, you must use the VA direct home loan to purchase or construct the property of your own. Properties for rental or investment are not qualified for the loan.

Your credit score must be in a satisfactory level, otherwise, you will be refused by VA. The income of you and your spouse must be stable and sufficient for the monthly payments, associated fees, as well as the expenses for other obligations.

Minute Physics creator Henry Reich doesn't shrink from tackling the big bang and other big deals in science, so it makes sense that he's now making sense of the Higgs boson. His timing is excellent, considering that the subatomic particle appears to have been discovered at Europe's $10 billion Large Hadron Collider. In today's three-minute video, Minute Physics explains how the Higgs boson subatomic particle fits into the bigger puzzle of the universe's structure at the lowest level ... and why physicists hope this isn't the end of the story.

But be forewarned: This is the first part of what's expected to be a three-part video series. And although Reich is well-versed in film as well as physics, this isn't a one-man operation. Reich relies on experts at Canada's Perimeter Institute for support and scientific back-stopping. So stay tuned for future installments of Minute Physics' Higgs boson saga.

The Godless Particle
Notice that the video makes no mention of the Higgs boson as the "God particle." That's a label that Nobel-winning physicist gave to the god-danged particle decades ago, but since then, scientists have come to loathe the term. In fact, the boson is better described as the "Godless Particle," says Lawrence Krauss, a theoretical physicist at Arizona State University. Here's his perspective, distilled into an email:

?The Higgs boson actually should probably be called the Godless particle. The background 'Higgs' field permeates all of space and is largely responsible for the existence of stars, planets and humans. The confirmation of the existence of this field strongly supports what modern physics has said for years: The many features of our universe can be largely accidental consequences of the conditions associated with the universe?s 'birth,' consistent with the laws of physics.

"Far from suggesting any higher power, the discovery at CERN takes particle physics one step further toward answering the question: 'Why is there something rather than nothing?' ? by demonstrating the plausibility of the idea that everything we see could arise naturally from an initial state of no particles, and maybe no space, and maybe even no fixed laws ? without supernatural shenanigans."

Andy Griffith, beloved family TV actor, dies

Andy Griffith, who starred in family TV favorites "The Andy?Griffith Show" and "Matlock," died today at age 86. His career spanned more than 50 years, but he was best known as Sheriff Andy Taylor.

Griffith died about 7 a.m. at his coastal home, Dare County Sheriff Doug Doughtie said in a statement.

"Mr. Griffith passed away this morning at his home peacefully and has been laid to rest on his beloved Roanoke Island," Doughtie told The Associated Press, reading from a family statement.

The family will release further information, the sheriff said.

He had suffered a heart attack and underwent quadruple bypass surgery in 2000.

Griffith's career spanned more than a half-century on stage, film and television, but he would always be best known as Sheriff Andy Taylor in the television show set in a North Carolina town not too different from Griffith's own hometown of Mount Airy, N.C.

Griffith set the show in the fictional town of Mayberry, N.C., where Sheriff Taylor was the dutiful nephew who ate pickles that tasted like kerosene because they were made by his loving Aunt Bee, played by the late Frances Bavier. He was a widowed father who offered gentle guidance to son Opie, played by Ron Howard, who grew up to become the Oscar-winning director of "A Beautiful Mind."

Don Knotts was the goofy Deputy Barney Fife, while Jim Nabors joined the show as Gomer Pyle, the unworldly, lovable gas pumper.

On "Matlock," which aired from 1986 through 1995, Griffith played a cagey Harvard-educated defense attorney who was Southern-bred and -mannered with a practice in Atlanta.

In his rumpled seersucker suit in a steamy courtroom (air conditioning would have spoiled the mood), Matlock could toy with a witness and tease out a confession like a folksy Perry Mason.

The character ? law-abiding, fatherly and lovable ? was much like Sheriff Andy Taylor with silver hair and a shingle.

In a 2007 interview with The Associated Press, Griffith said "The Andy?Griffith Show," which initially aired from 1960 to 1968, was seen somewhere in the world every day. A reunion movie, "Return to Mayberry," was the top-rated TV movie of the 1985-86 season.

"The Andy?Griffith Show" was a loving portrait of the town where few grew up but many wished they did ? a place where all foibles are forgiven and friendships are forever. Villains came through town and moved on, usually changed by their stay in Mayberry. That was all a credit to Griffith, said Craig Fincannon, who met Griffith in 1974.

HBT: Harper would vote Chipper an All-Star

Bryce Harper has to be considered the favorite to win the NL Final Vote for the last spot on the All-Star team, but he said after Sunday?s game that, ?I?d vote for Chipper.?

Harper and Chipper Jones are in the mix along with Michael Bourn, Aaron Hill and David Freese in the Final Vote, but really, it figures to be a two-man race. In typical buddy-cop-movie fashion, it?s the brash, young rookie versus the weary veteran a few months away from retirement.

Ideally, there?d be room for both, and if Matt Kemp is forced to skip the game with his hamstring injury, as seems likely, perhaps there will be. Harper, though, thinks Chipper should go to one last game at age 40. Jones has been to seven All-Star Games, including last year?s. At .292/.375/.455, he?s been plenty productive this year, though he?s played in just 44 games. Harper is hitting .274/.348/.471 in 57 games.
